How US Online Gambling works

  • Cost for operators - For instance, the 36% levy on sports betting revenue in addition to the $10 million to acquire a license in Pennsylvania could be a barrier for some operators.

But another reason why the availability of gambling sites vary between states can also be down to how operators view the US gambling market from a business perspective. Some may decide to prioritize certain markets over others, while others may have more of a long-term strategy in place.

DraftKings, FanDuel, BetMGM, and PointsBet, for example, have been very aggressive in expanding their presence in the US and launched in the majority of online gambling states. Online gambling, which essentially means gambling over the internet, comprises several types: online sports betting, online casino, online poker, and, for some people, online lottery too.

And since the rules for online gambling varies greatly from state-to-state, knowing what state allows which type of online gambling can be a bit tricky to follow.

This section provides some background regarding each type of vertical, where it is allowed in the US, and how each market operates.

Online Sports Betting

Before 2018, sports betting (never mind online sports betting) was banned in the US, except for Nevada.

A select number of states - Delaware, Oregon, and Montana - were allowed to operate a very limited sports betting market. But, essentially, if you wanted to bet on sports, legally, you had to jump on a plane to The Silver State.

However, this all changed on May 14, 2018, when the long-standing ban, aka the Professional and Amateur Sports Protection Act (PASPA), was abolished, thanks to a legal challenge by the state of New Jersey.

The landmark decision allowed legal sports betting to be authorized at state level and ever since we’ve seen state-after-state take up the opportunity.

Where are sports betting sites allowed?

Online sports betting sites are legal in New Jersey, Pennsylvania, Indiana, West Virginia, Colorado, Illinois, Iowa, Oregon, Rhode Island, New Hampshire, Montana, Tennessee, Virginia, and Michigan.

Mobile wagering is permitted statewide via sports gambling websites and apps in each state (excluding Montana). This means bettors can place an online wager via a laptop/computer, mobile device, or tablet anywhere in state lines. Additionally, players are not required to register or fund their accounts in-person - this can also be done remotely.

In most states, for instance, New Jersey, Pennsylvania, Indiana, Colorado, the choice of online sports gambling websites is vast and is continually added to thanks to an open market. However, in some states, namely Oregon, Rhode Island, New Hampshire, and Montana, online sports gambling options are limited to one sole operator regulated by the state lottery.

Only in New Jersey, Delaware, Pennsylvania, West Virginia, and Michigan can you play online casinos, legally.

In New Jersey, Pennsylvania, West Virginia, and Michigan, online casinos are available statewide via websites and mobile apps. allows players to play casino games and sign-up for an online gambling account wherever they are in their state, whether it be at home, at work or out getting the groceries!

Delaware is a bit different in that the market is controlled by the Delaware State Lottery. Options are therefore restricted to three local websites.

Indiana and Illinois are highly likely to add online casinos to their current online gambling bills at some point in 2021.
